בשבוע שעבר פסק בג"ץ כי חוק הפיקדון אינו חוקתי. החוק שנכנס לתוקף במאי 2017 מחייב את מבקשי המקלט להפקיד %20 ממשכורתם מדי חודש לקופת פיקדון שתהיה נגישה להם אם כאשר יעזבו את ישראל. בנוסף, המעסיקים חויבו להפקיד עוד %16 לאותה קופה החוק הזה היווה נטל עצום על חברי הקהילה שלנו, שרובם ממילא עובדים במשרות בשכר נמוך

במרכז לקהילה האפריקאית בירושלים יש הרבה חברי קהילה ומתנדבים שמחו נגד ה חוק ואנו מאוד מרוצים מהחלטת בית המשפט לבטלו. על פי פסיקת בית המשפט לממשלה הוקצו שלושים יום להחזיר את הכספים. עם זאת, יש להדגיש כי רק %40מחברי הקהילה עשויים להפיק מכך תועלת מאחר שמעסיקים רבים לא הקפידו למלא את החוק. הדבר משאיר את הקהילה ללא רשת ביטחון או גישה לסיוע ממשלתי

אמנם פסק דינו של בג"ץ הקובע כי חוק הפיקדון אינו חוקתי מתקן עוול נורא, אך הוא אינו מתקן מציאות שאיתה מתמודדים רוב מבקשי המקלט בירושלים בתקופה זאת של משבר הקורונה. הקהילה עדיין מתמודדת עם משבר הומניטרי ואנחנו זקוקים לעזרתכם בכדי להבטיח כי תהיה להם האפשרות לרכוש מזון, לשלם עבור דיור וטיפול רפואי במהלך תקופה זו.

Dear Friends and Supporters,

These are especially challenging times for all of us – and I hope this message finds you and your loved ones safe and healthy.

Last week Israel’s High Court of Justice ruled that the Deposit Law imposed on asylum seekers is unconstitutional. The law, which went into effect in May 2017, required asylum seekers to pay 20% of their salaries each month into a ‘deposit fund’ they could access only if and when they leave Israel. In addition, the employers were required to pay another 16% into the same fund. This law has become an enormous burden for our community members, most of whom already work low-wage jobs.

We at the Jerusalem African Community Center have many community members and volunteers who advocated against this law, and we are pleased by the Court’s decision to annul it. According to the ruling, the government has thirty days to refund those who deposited the 20% of their salaries. In practice, less than 40% of community members are expected to benefit, as many employers did not adhere to the law. This still leaves the community without a safety net or access to government aid.

While Israel’s High Court of Justice’s ruling that the Deposit Law is unconstitutional corrects an obvious injustice, it will not fix the current reality most of Jerusalem’s asylum seekers face during the Coronavirus crisis. The community still faces a humanitarian crisis and we need your help to ensure that they have the access to food, housing and medical care during this time.
